1. Purpose

This Art in State Buildings Policy (“Policy”) enhances implementation of the Art in State Buildings (“ASB”) Program at the University of Florida (“UF”) by supplementing Section 255.043, Florida Statutes, and Rule 1T-1.033, Florida Administrative Code, including the ASB Program Handbook for State Agencies (the “ASB Handbook”).

2. Applicability

This Policy applies to all entities that contract with the UF Board of Trustees as its signatory as well as UF’s affiliated practice plans. To the extent any portion of this Policy conflicts with other university rules, policies, or procedures, this Policy shall control.

3. Definitions

4. Policy Statement

4.1. Relationship to Other Laws

The requirements of this Policy are in addition to those in Section 255.043, Florida Statutes, and Rule 1T-1.033, Florida Administrative Code, including the ASB Handbook.

4.2. ASB Program Evaluation Standard

When selecting artwork for the university, the ASB Administrator and Art Selection Committee must select only those works of art for acquisition that are produced by, but not limited to, Florida artists or craftspersons, and that constitute the best value to the university, giving due consideration to maintenance, longevity, site logistics, artist experience, and workmanship. When selecting an artist to provide artwork to the university, the ASB Administrator and Art Selection Committee must select only those artists who have significant experience in creating works of art that have little ongoing maintenance expenses and are otherwise suitable for a Floridian campus environment.

4.3. ASB Program Appropriation

Section 255.043, Florida Statutes, permits a portion of each appropriation for the original construction of a university building to be allocated for the acquisition of works of art that are produced by, but not limited to, Florida artists or craftspersons and that will be displayed in publicly accessible areas of the building. As of the date of this Policy, up to 0.5% of the total construction allocation for the building, with a cap of $100,000, may be allocated for such acquisitions. Subject to Section 255.043, Florida Statutes, as amended from time to time, the Vice President for Construction, Facilities, and Real Estate (the “VP”) will establish the amount of each eligible construction appropriation that may be used for the acquisition of eligible works of art.

4.4. Art Selection Personnel

4.4.1. No Art Selection Committee. Where an acquisition will be made without an Art Selection Committee, the ASB Administrator must consult with the VP or VP’s designee on the artwork selection.

4.4.2. Art Selection Committee. Where an acquisition will be made with an Art Selection Committee, the User Agency Representative must be the VP or VP’s designee.

4.5. Art Selection Process

4.5.1. Method of Solicitation. Works of art and artists must be selected by Open Competition, except as otherwise approved by the VP. However, the ASB Administrator may invite artists to participate in any Open Competition conducted by the university.

4.5.2. Finalist Review Method. Absent a compelling university interest in selecting an artist rather than an artwork, all selections are to be for the selection of a specific work of art. If the ASB Administrator or Art Selection Committee desires to select an artist to provide a work of art to the university, then the ASB Administrator must provide the VP with a written justification for the use of the Presentation selection method before commencing such a selection.

4.6. Contract for Art

Contracts will consist of a bilateral agreement signed by the President or President’s designee before any work of art is delivered or artist services rendered. A purchase order will also be issued under the contract, as appropriate. No more than the lesser of $5000 or 10% of the total compensation may be paid to the artist prior to university approval of the final specifications, budget, installation schedule, and design for the work of art to be created and installed by the artist.

4.7. Art Evaluation Committee

When an Art Evaluation Committee is convened under the ASB Handbook, the agency representative on such committee must be the VP or VP’s designee.

4.8. Policy Violations

The VP or VP’s designee is authorized to impose appropriate sanctions against those who fail to follow university regulations or policies. If a person violates this Policy, the VP or VP’s designee may take any corrective action necessary to redress the violation. The decision of the VP or VP’s designee is final.
